Armed Robbers Stole Igboho Supporters’ Case File From Our Custody -DSS

The State Security Service on Wednesday told the Abuja Division of the Federal High Court that armed robbers have carted away the case file of Sunday Igboho’s supporters who have been in custody since the brutal invasion of their residence in Ibadan weeks ago. 

A lawyer representing the SSS told Justice Obiora Egwuatu that the incident came when armed robbers operating a one-chance cartel stole attacked an official in charge of the documents. 

He did not immediately say whether the incident occurred in Abuja or other parts of the country. 

The lawyer said the matter should be adjourned, but the court has yet to accede to the request as of the time of filing this report.

After 53 days in the custody of the Department of State Services, the 12 aides of embattled Yoruba Nation agitator, Sunday Adeyemo aka Sunday Igboho, are set to taste freedom again as Justice Obiora Egwuatu of the Federal High Court, Abuja on Monday signed their Release Order.

The PUNCH learnt that the presiding judge ignored the persistent argument of the DSS lawyer, Idowu Awo, and signed the Release Order of the four contested detainees.

They are Amudat Babatunde, Abideen Shittu, Jamiu Oyetunji, and Bamidele Sunday.

The detainees’ lawyer, Pelumi Olajengbesi, confirmed the development to our correspondent on Monday.

He said the judge could not sign the Release Order of the other eight detainees because three of the sureties withdrew before concluding the process of perfecting the bail conditions of his clients.

The eight detainees are Abdullateef Onaolapo, Tajudeen Irinloye, Dikeola Ademola, Ayobami Donald, Uthman Adelabu, Olakunle Oluwapelumi, Raji Kazeem, and Taiwo Tajudeen.

Olajengbesi, however, expressed optimism that the three sureties that pulled out would be replaced and the judge would sign their Release Order too.

The lawyer also urged the DSS to comply with the court order and release his clients immediately.

Recall that the DSS had approached a Court of Appeal sitting in Abuja to revoke the bail earlier granted by the Federal High Court in Abuja to the contested four — Babatunde, Shittu, Oyetunji and Sunday.

The secret police had expressed strong dissatisfaction against the ruling of Justice Egwuatu on August 4, 2021, granting bail to all the detainees, against the objection of the DSS lawyer that Babatunde, Shittu, Oyetunji and Sunday should not be granted bail.

While Awo did not oppose the bail of the other eight, he had said investigations revealed that the four contested detainees — Babatunde, Shittu, Oyetunji and Sunday — were heavily involved in the alleged offence of arms stockpiling and other criminal activities of their boss, Igboho.

But Justice Egwuatu had on August 4 admitted all the 12 applicants to bail including Babatunde, Shittu, Oyetunji and Sunday.

The court had categorised the bail granted to the applicants into two:-

Eight of the detainees were admitted to bail in the sum of N5m, two sureties each resident in Abuja, with evidence of two years’ tax payment.

The remaining four – whose bail the DSS opposed – had their bail terms in the sum of N10m, two sureties each resident in Abuja with one of them being a civil servant in a Federal Government ministry or any of its agencies with grade-level not less than 12.

The 24 sureties had been secured last week but the presiding judge who was to sign their Release Order was said to have travelled abroad.

But Justice Egwuatu on Monday signed the Release Order of the contested four who had their complete eight sureties. He is also expected to sign the Release Order of the remaining eight once their 16 sureties were completed.

All the detainees were arrested around 1am on July 1, 2021, when the DSS “raided” Igboho’s Ibadan residence in a Gestapo style.

The secret police also said its operatives killed two other associates of the activist in a “gun duel.”

The 12 detainees had approached the court to seek their release.

Igboho, wanted by the DSS, has been in detention in Cotonou, Benin Republic, since July 19, 2021 when he was arrested at an airport as he tried to board a Germany-bound flight.

Yoruba Nation: Sunday Igboho was chained to prevent him from turning into cat, disappearing —  Lawyer

Olusegun Falola, one of the lawyers of Yoruba Nation activist, Sunday Adeyemo popularly known as Igboho, has disclosed why the agitator was initially chained by the Benin Republic security agents.

Falola disclosed that Igboho was chained to prevent him from disappearing mysteriously. According to him, Beninese security agents were told that Igboho could turn into a cat and escape.

“When I arrived from Paris and got to the custody where Igboho was detained, he was first chained. They were scared that he could just disappear into the thin air because of his mystical powers. The police told me that if Igboho’s chains were untied and he escaped mysteriously, he (the police officer) would be stripped of his rank and also dismissed.

The police officer said he was told that Igboho could disappear or turn into a cat, and many other things were said to the police officers which made them tie him,” he told TheNation newspaper. The lawyer, however, disclosed that his timely intervention led to the officers unchaining Igboho.

Former President Olusegun Obasanjo was in Benin Republic some days ago over the Sunday Igboho debacle, The Cable reports.

He had travelled to Zanzibar in Tanzania on August 1 and rerouted to the Francophone nation.

Obasanjo was said to have met with Benin’s President Patrice Talon after his condolence visit to Nicephore Soglo on his wife’s demise. Roseline was 87 years old.

Soglo was Beninise President from 1991 to 1996 and was one of the African leaders who intervened when the late General Sani Abacha jailed Obasanjo in 1995.

Confusion, uncertainty over Sunday Igboho’s detention in Benin, extradition to Nigeria

Igboho is in trouble in Nigeria and the Benin Republic. While the latter is probing the passport he carried, Nigerian authorities accuse him of planning to stage a war against the state.

Nigeria will barely face stiff resistance from the Beninise government.

Apart from decades of close bond, Africa’s most populous nation plays a “big brother” role to its neighbour.

Justice Ladiean Akintola of the Oyo High Court has approved an ex-parte motion restraining the Attorney General of the Federation, Abubakar Malami, and the Department of State Security (DSS) from arresting, harassing, intimidating and blocking bank accounts of Yoruba Nation agitator, Sunday Adeyemo, popularly known as Sunday Igboho.

The order was approved after an ex-parte motion moved by Igboho’s lawyer, Chief Yomi Aliu (SAN), at the court on Wednesday.

“The court has ordered that he must not be arrested, detained, or killed in the next 14 days. The account also said that his account should not be blocked,” Yomi Aliu said following the case.

The motion developed from the originating motion seeking N500 billion damages for invasion of his house in Ibadan, the Oyo State capital, last month.

Aliu expressed confidence that Malami will not disobey the court order, stressing that it was given directly against his office.

However, the hearing in the suit was adjourned to August 18.

We have insisted on due process and the presentation of hard evidence before my friend and brother Sunday Igboho can be extradited from Cotonou to Nigeria.  

We have condemned the illegal manner in which the Kenyan authorities kidnapped Nnamdi Kanu and returned him to Nigeria. 

Those that are complaining about us asking for due process and insisting on the presentation of hard evidence before a court of law before Abba Kyari can be extradicted to America are myopic and naive.

You cannot insist on due process for Igboho and Nnamdi Kanu and deny it to Abba Kyari. 

You cannot be selective in your application of justice. 
You cannot have it both ways: you either believe in the rule of law or you do not. You either believe in due process, fairness, equity and justice or you do not. 

We stood up for Allen Onyeama of Air Peace when the Americans wanted his head. In the end he was vindicated as there was no hard evidence against him and we discovered that the whole thing was a conspiracy to destroy him and take over his business. 

Why should we not accord Abba the same benefit of the doubt or protection given the fact that he is also a Nigerian. Or is it that some Nigerians are more equal than others? 

The fact that Abba is a policeman or a northern Muslim does not mean we should feed him to the dogs. The fact that he was in SARS does not mean we should crucify him. 

Resigning our sovereignty to the Americans and acting as if they are God by considering one of our own guilty simply because they have indicted him or wish to investigate him is utterly shameful. 

I accord the same presumption of innocence unless and until proven guilty by a court of law to Abba as I do to Sunday and Nnamdi. 

I refuse to apply the rules and the law selectively. I refuse to allow my emotions to becloud my better judgement. 

I refuse to associate myself with any witch hunt or to be infected by a herd and lynch mob mentality. 

This is because I have been a victim of such myself many times in the past and I know what it is like. 

We are all equal before the law and we must not apply it selectively or on a regional, religious or ethnic basis. 

It is Sunday, Abba and Nnamdi today: it could be you tomorrow. And when that happens the only thing left to protect you from injustice are God and the law.

Morale of the tale: always be cautious before you condemn and assume guilt and always insist on hearing the other side of the story and seeing the evidence before you accept the assertions and allegations of either the state or an individual as being true and valid. 

There is nothing more grievous before God than to send an innocent man to the gallows or to wrongly accuse the innocent and it comes with curses.

When DSS stormed Sunday Igboho’s house at midnight and killed innocent people while also arresting a cat, you hailed it. 

Now, you are calling for due process and understanding for Kyari?

You that were jumping up and down when some people, who should be more concerned about killer herdsmen, bandits and Boko Haram, placed a bounty on Nnamdi Kanu, are the one now saying FBI should mind their business? 

You are now now saying Nigeria does not have an extradition treaty with America (we do), but you were hailing Buhari for putting pressure on Benin Republic to extrajudicially extradite Igboho to Nigeria? 

Shebi Yoruba, Igbo and North are all represented here? Let us do Federal Character and treat them the same.
